1. About SpiritsandChocolates

These Terms & Conditions apply to orders, products and services supplied by SpiritsandChocolates, established in the Netherlands and registered with the Dutch Chamber of Commerce (KvK) under number 91522919.

Contact details and other company information can be found on the SpiritsandChocolates website.

Where these Terms & Conditions refer to “I”, “me” or “SpiritsandChocolates”, this means the business SpiritsandChocolates.

2. Applicability

These Terms & Conditions apply to all orders and agreements entered into with SpiritsandChocolates, including orders placed through the online shop.

By placing an order, the customer agrees to these Terms & Conditions.

The Terms & Conditions are made available to the customer before an order is completed and can be viewed and saved.

Where additional arrangements are agreed for a specific product, activity or custom order, these apply in addition to these Terms & Conditions.

3. Age and Alcohol

Some SpiritsandChocolates products contain alcohol.

The website and alcohol-containing products are intended only for persons aged 18 or over, or the higher legal minimum age applicable in the purchaser's country.

By ordering alcohol-containing products, the purchaser declares that they meet the applicable legal age requirements.

The purchaser is responsible for the responsible consumption of products containing alcohol.

4. Product Information

I take great care in describing and presenting my products.

Because my chocolates are handcrafted, slight variations in colour, shape, decoration and finish may occur. Such minor variations do not affect the quality of the product.

Information concerning ingredients, allergens and other important product information is provided, where applicable, with the product, on the packaging or on the website.

5. Prices

The prices displayed on the website at the time the order is placed apply to that order.

Where applicable, it will be indicated whether prices include or exclude VAT.

Any shipping costs or other additional charges will be clearly shown before the customer completes the order.

Separate prices and arrangements may apply to business orders and custom-made products.

6. Ordering and Payment

An agreement is concluded after an order has been placed through the online shop and the payment or order has been confirmed.

Available payment methods are displayed during checkout.

Separate quotations or payment arrangements may apply to custom-made products, larger business orders or special commissions.

7. Delivery

Orders are shipped to the delivery address provided by the purchaser.

The purchaser is responsible for providing a complete and correct delivery address.

I make every reasonable effort to dispatch orders within the indicated period. An indicated delivery date is an estimate unless expressly agreed otherwise.

If an order cannot be delivered, or cannot be delivered within the agreed period, I will contact the purchaser as soon as reasonably possible.

8. International Orders

SpiritsandChocolates may ship products internationally where delivery to the country concerned is possible and permitted.

The purchaser is responsible for complying with local laws and regulations relating to the receipt and possession of the ordered products.

Any import duties, local taxes, customs charges or other charges imposed in the destination country are the responsibility of the purchaser unless expressly stated otherwise before purchase.

9. Right of Withdrawal and Returns

Consumers purchasing online generally have a statutory 14-day right of withdrawal, unless a legal exception applies.

Where the right of withdrawal applies, the consumer may notify SpiritsandChocolates within the statutory period that they wish to withdraw from the purchase.

After withdrawal, the product must be returned within the applicable statutory period.

Sealed Products

Chocolate boxes and certain other SpiritsandChocolates products are supplied sealed for reasons of food safety and hygiene.

For products that are not suitable for return for reasons of health protection or hygiene, the right of withdrawal is lost once the seal has been broken after delivery, insofar as the applicable statutory exception to the right of withdrawal applies.

If the seal remains completely intact and no other statutory exception applies, the statutory rules concerning the right of withdrawal remain applicable.

Return Shipping Costs

Where a consumer exercises the right of withdrawal, the direct cost of returning the product is payable by the purchaser. The purchaser will be informed of this before placing the order.

Customers are advised to retain proof of return shipment.

This provision does not apply where a product has been supplied incorrectly, damaged or defective and SpiritsandChocolates is legally responsible for providing a remedy.

10. Refunds Following Withdrawal

Where the right of withdrawal is validly exercised, amounts due will be refunded in accordance with applicable law.

When the entire order is withdrawn, the original standard delivery costs will also be refunded. Additional delivery costs resulting from the purchaser choosing a more expensive delivery method than the standard delivery offered do not have to be refunded.

Refunds will be made within the applicable statutory period. SpiritsandChocolates may withhold reimbursement until the returned product has been received or until the consumer provides evidence that the product has been returned, whichever occurs first.

Refunds will generally be made using the same payment method used for the original transaction.

11. Custom-Made and Personalised Products

The statutory right of withdrawal may not apply to products manufactured according to the customer's individual wishes or specifications.

This may include specially composed chocolates, specific colours, company logos, corporate orders or other products manufactured specifically for an individual customer.

Where the right of withdrawal does not apply to a custom-made product, the customer will be clearly informed before placing the order.

12. The Battle of Taste – Home Edition

In addition to these Terms & Conditions, specific conditions displayed with The Battle of Taste – Home Edition may apply.

Where the right of withdrawal applies, the safety seal must remain intact when that seal is required in order for the product to be returnable for reasons of health protection or hygiene.

The direct costs of returning the product when exercising the right of withdrawal are payable by the purchaser.

Digital components and access codes included with the game may be subject to separate statutory rules governing digital content.

Where prior consent or acknowledgement of the loss of the right of withdrawal is legally required for digital content, this will be requested separately during the ordering process.

13. Workshops, Tastings and Activities

Additional conditions may apply to workshops, tastings, The Battle of Taste activities and other events regarding dates, times, number of participants, payment and cancellation.

Where a date must first be agreed for an activity, this must be arranged before completing the booking when this is stated in the relevant offer.

Any specific cancellation conditions will be communicated to the customer before the booking is completed.

14. Damaged, Incorrect or Defective Products

If the purchaser receives an incorrect product, or a product arrives damaged or defective, please contact SpiritsandChocolates as soon as possible.

In the event of transport damage, customers are requested, where possible, to provide photographs of the product, packaging and shipping label. This allows the issue to be assessed more quickly and an appropriate solution to be offered.

This provision does not limit the consumer's statutory rights.

Where SpiritsandChocolates is legally responsible for the problem, necessary costs relating to return, replacement or another appropriate remedy will not be charged to the consumer.

15. Complaints

If you are not satisfied with your order or service, please contact SpiritsandChocolates using the contact details provided on the website.

I will always try to resolve complaints directly and reasonably.

Submitting a complaint does not affect the consumer's statutory rights.

16. Liability

SpiritsandChocolates is responsible for fulfilling its obligations under the agreement in accordance with applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

To the extent permitted by law, SpiritsandChocolates is not responsible for damage resulting from improper use of a product, disregard of supplied product or allergen information, or irresponsible consumption of products containing alcohol.

17. Force Majeure

If fulfilment of an order becomes temporarily or permanently impossible due to circumstances reasonably beyond my control, I will contact the customer as soon as possible.

An appropriate solution will then be considered, such as delayed delivery, an alternative product or — where required by law or the agreement — a refund.

18. Privacy

Personal data is processed in accordance with applicable privacy legislation and the SpiritsandChocolates privacy policy.

Personal data is used only where there is a valid legal basis, including processing and delivering orders, providing customer service and meeting statutory administrative obligations.

19. Online Withdrawal

Where a consumer has a statutory right of withdrawal, the consumer may exercise this right through the legally required online withdrawal function provided on the website or by another method permitted by law.

Following an online withdrawal, the consumer will receive the confirmation required by applicable law.

20. Applicable Law

Agreements with SpiritsandChocolates are governed by Dutch law.

This choice of law does not deprive consumers of mandatory consumer protection rights available to them under the laws of their country of residence.

The parties will first attempt to resolve any dispute by mutual agreement.

21. Amendments

SpiritsandChocolates may amend these Terms & Conditions where necessary, for example because of changes in legislation or business operations.

An order remains subject to the Terms & Conditions that applied when the agreement was concluded.

Competition – Terms & Conditions

These Terms & Conditions apply to the competitions organised by SpiritsandChocolates through spiritsandchocolates.com.

1. Eligibility
Participation is free of charge and open only to persons aged 18 years or older.

2. Competition period
Each competition runs during the period stated with that specific competition. Entries received after the stated closing date and time will not be accepted.

3. How to enter
Participants must follow the instructions provided with the competition. Only entries that meet the stated requirements will be considered valid.

Please read the question and instructions carefully — there may be more to them than first meets the eye. 😉

4. Winner selection
The winner or winners will be selected from all valid correct entries. If several participants submit the correct answer, the winner(s) will be selected at random unless otherwise stated in the competition.

5. The prize
The prize will be described with each individual competition.Prizes cannot be exchanged for cash or replaced by a cash payment.

Where a prize contains chocolates made with alcoholic spirits, the prize will only be awarded to a person aged 18 or older.

6. Notification of winners
Winners will be contacted using the contact information supplied when entering the competition and/or announced through the official communication channels of SpiritsandChocolates.

SpiritsandChocolates will never ask a winner to provide credit card details, online banking credentials or to make a payment in order to receive a prize.

7. Personal information
Personal information supplied for participation will only be used for administering the competition and contacting the winner, unless the participant has separately given permission for another purpose.

8. Fair participation
SpiritsandChocolates reserves the right to exclude entries involving fraud, manipulation, automated participation or other unfair methods.

9. Changes or cancellation
In exceptional circumstances, SpiritsandChocolates reserves the right to amend, postpone or cancel a competition where reasonably necessary.

10. Acceptance of these Terms & Conditions
By participating in a competition, the participant agrees to these Terms & Conditions and to the specific instructions accompanying that competition.
